Terms of Service

These Terms of Service ("Terms") are an agreement between you and Jacard AI, Inc., 360 S Baywood Ave, San Jose, CA 95128 ("Jacard", "we", "us"). They govern your use of jacard.ai, Jacard AI Retail, and Jacard Olympus (together, the "Services"). By using the Services, you agree to these Terms. If you use the Services on behalf of a company, you confirm you have authority to bind that company, and "you" means the company.
Acceptance and who may use the Services
You must be at least 18 years old to use the Services, or use them under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. If you do not agree to these Terms, do not use the Services.
The Services
- jacard.ai is a free, public generative-UI analysis engine. You submit a prompt (and optionally upload files), and the service generates interactive analysis pages we call Jacard Views. You can also deploy standalone pages ("Jacard Pages") to public URLs and create public share links for chats and views.
- Jacard AI Retail (shopping.jacard.ai) is a merchant console and embedded Shopify app. With merchant authorization, it ingests product catalogs, enriches them (for example, image captions and embeddings), indexes public advertising data, and generates storefront and collection pages that merchants can review and publish.
- Jacard Olympus is a B2B workspace where AI agents analyze company data through scoped, metered API keys, with agent sessions persisted in private repositories and human approval prompts gating sensitive actions.
Jacard AI Retail and Jacard Olympus are early-access products. See "Beta and early access" below.
Accounts and guest mode
You can use parts of jacard.ai as a guest without an account. Some features require an account, which you can create with an email address and password or by signing in with Google. You are responsible for keeping your credentials secure and for activity under your account. Tell us promptly at legal@jacard.ai if you believe your account has been compromised. Our handling of personal data is described in our Privacy Policy, which reflects our obligations under laws including the EU GDPR and US state privacy laws such as the CCPA/CPRA.
Acceptable use
You agree not to:
- Use the Services for unlawful purposes or to create, upload, or publish content that is illegal, infringing, or harmful to others.
- Scrape, crawl, or bulk-extract from the Services in ways that degrade them or evade our controls.
- Attempt to bypass rate limits, usage quotas, data-access budgets, sandboxing, or permission prompts.
- Use generated pages, public URLs, or share links for spam, phishing, fraud, or impersonation.
- Probe, disable, or interfere with the security or integrity of the Services, or access data or accounts that are not yours.
We may throttle, suspend, or remove content or accounts that violate this section.
Your content and our license
You own the content you submit, including prompts, uploaded files, conversations, catalog data, and the pages generated for you ("User Content"). You grant us a worldwide, non-exclusive license to host, store, process, transmit, and display User Content as needed to operate, secure, and improve the Services, including processing by the third-party infrastructure and AI model providers listed in our Privacy Policy.
Published and shared content is public by design. When you deploy a Jacard Page or create a share link for a chat or view, that content becomes accessible to anyone with the URL. Do not publish or share content you want to keep private. You are responsible for the content you make public.
AI-generated output
The Services use AI models to generate content. AI output can be inaccurate, incomplete, or outdated, and we make no warranty about its accuracy or fitness for any purpose. You are responsible for reviewing output before relying on it or publishing it. Because models can produce similar responses to similar prompts, output generated for you may resemble output generated for other users, and we cannot guarantee its uniqueness.
Merchant terms
Merchants using Jacard AI Retail authorize our access to their store data through Shopify's APIs and Shopify's own authorization flow. Merchants are responsible for the pages they choose to publish and for their compliance with Shopify's terms and applicable commerce and consumer-protection laws. Organization customers of Jacard Olympus may have a separate written agreement with us; where one exists, it prevails over these Terms for that service.
Quotas, rate limits, and fair use
The Services enforce rate limits, usage quotas, and daily budgets on data access. These protect service quality for everyone. We may adjust limits at any time, and we may restrict accounts whose usage patterns harm the Services or other users.
Intellectual property
The Services (including our software, models of operation, designs, and branding) are owned by us or our licensors. These Terms do not transfer any of our intellectual property to you. Feedback you choose to give us may be used without obligation to you.
Beta and early access
Jacard AI Retail and Jacard Olympus are provided as early-access software. Features may change, break, or be discontinued; data formats may change; and availability is not guaranteed. Early-access services are provided for evaluation and should not be your only system of record.
Disclaimers and limitation of liability
The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are an early-stage company and do not promise uninterrupted or error-free operation.
To the maximum extent permitted by law, neither party is liable to the other for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Each party's total aggregate liability arising out of these Terms or the Services is limited to the greater of the amounts you paid us in the 12 months before the claim or USD 100. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or willful misconduct.
Termination
You may stop using the Services or delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue a Service; where practical, we will give you notice and a chance to export your content. Sections that by their nature should survive (including content licenses for already-published public pages, disclaimers, limitation of liability, and governing law) survive termination.
Governing law
These Terms are governed by the laws of the State of [State, e.g. Delaware], United States, without regard to conflict-of-laws rules, and the state and federal courts located in [County, State] have exclusive jurisdiction over disputes arising from them, subject to any non-waivable consumer rights you hold in your place of residence.
Changes to these Terms
We may update these Terms as the Services evolve. For material changes we will give reasonable notice, such as by email or an in-product notice. Continuing to use the Services after changes take effect means you accept the updated Terms.
